About this project

Jessica A. from Freundeskreis der Law Clinic an der BLS e.V. is responsible for this project
The Abschiebehaftberatung Nord is a joint project of the Refugee Law Clinic Hamburg, Refugee Law Clinic Kiel and the Law Clinic of Bucerius Law School Hamburg.

What is deportation detention?

Deportation detention is not punitive detention. Its sole purpose is to enforce the obligation to leave the country. Detention can last up to 18 months, on average 4 weeks. According to Peter Fahlbusch, a lawyer and expert on deportation detention, about half of all detentions are unlawful. In deportation detention, you don't automatically get a lawyer, so most people can't defend themselves against violations of the law.

What do we do?
As a voluntary student legal advice service, we support people in deportation detention free of charge. We do this by participating in the detention procedure as a so-called person of trust. As private persons, we are therefore parties to the legal proceedings and, if we lose, we can be ordered to pay the legal costs .

What do we need the money for?
We would like to counsel at least 50 prisoners a year, but preferably 70 or even 100. We would also like to organise training and information events. We need the donations to finance court proceedings as well as material, personnel and fee costs (e.g. for legal training).
So far, all our funding applications for 2023 have been rejected. The people we advocate for have no lobby, and many funding bodies consider help for deportation prisoners to be too political. We don't get other funding for formal reasons; for example, we are based in Hamburg, but we now work mainly in Glückstadt in Schleswig-Holstein, with prisoners from three federal states (HH, MV & SH).

  •  With 2.000€ we can finance about 10 proceedings.
  •  If we raise 5.000€, we have about one quarter more time to look for other funding possibilities.
  •  With 10.000€ we can cover our project and training costs for half a year.
  •  With 25.000€ we can concentrate on our operational work for at least one year while also searching for longer-term funding possibilities.
Please support us with your donation so that we can continue to support people in deportation detention & contribute to a minimum level of rule of law. Thank you!
